Thanks for visiting Mafematica.com.au ABN 30 167 364 552. Mafematica trades as mSmart and mProjections and owns web domains using these names. These terms and conditions (T&Cs) tell you what we expect of you and you of us when you use our site. Mafematica makes an effort to be open and these T&Cs set out the details for when browsing or using Mafematica products.  Please read the entire document.

Internet Conditions of Fair Use

Use of Mafematica internet services is NOT intended for business use. Business users may not run reports for multiple clients without prior written agreement from Mafematica. 

Individual’s Responsibility Access to the Mafematica IT systems is controlled and tracked by the use of User IDs, passwords and/or tokens. All User IDs and passwords are to be uniquely assigned to named individuals and consequently, individuals are accountable for all actions on the Mafematica IT systems.

Individuals must not:

  • Allow anyone else to use their user ID/token and password on any Mafematica IT system.
  • Leave their user accounts logged in at an unattended and unlocked computer.
  • Use someone else’s user ID and password to access Mafematica’s IT systems.
  • Leave their password unprotected (for example writing it down).
  • Perform any unauthorised changes to Mafematica’s IT systems or information.
  • Attempt to access data that they are not authorised to use or access.
  • Exceed the limits of their authorisation or specific business need to interrogate the system or data.
  • Connect any non-Mafematica authorised device to the Mafematica network or IT systems.
  • Store Mafematica data on any non-authorised Mafematica equipment.
  • Give or transfer Mafematica data or software to any person or organization without the authority of Mafematica.

Personal use is permitted where such use is not detrimental to Mafematica in any way, not in breach of any term and condition hereof and does not place the individual or Mafematica in breach of statutory or other legal obligations. All individuals are accountable for their actions on the internet.  User agrees that Mafematica may cancel User’s or Affiliate’s subscription without refund in its absolute discretion if it suspects that User or Affiliate has breached these Fair Usage terms.

Use

  • You can use our sites as long as you don’t steal, or use our content without sourcing or referencing it to us,
  • You must take responsibility for your data entry and the use of our Reports : don’t use our sites to exaggerate your data or enter data that gives you a ‘better result’.
  • When you become a paying client, we’ll bill you on an annual basis. We will endeavour to notify you in advance of a payment, but you must cancel the payments to discontinue subscription. If you have any problems you can email us on info@mProjections.com.au.

Other, up front issues

The Report associated with this web site is issued under ASIC instrument 2016/207 which exempts the provider of the calculator from the AFS Licensing or advice obligations in the Act.

How T&Cs work

In these T&Cs “you” are the user of the Sites. You can be a person, a corporate entity or another entity incorporated or unincorporated, like an association.

A Mafematica “Site” or Sites, is about this website, including our content and the member areas of the website.

We may change these T&Cs from time to time. You should know that by continuing to use our Sites you’re agreeing to the updated T&Cs. To make it easy for you to find the latest T&Cs, we provide a link at the bottom of each page of this website and other Sites and platforms as appropriate.

We’re “Mafematica”. Mafematica has a vision to be a next generation financial services investment and investment forecasting tool (software as a service) and will operate with a suite of modules under the mSmart brand and related brands such as mProjections.

By using, subscribing and/or subscribing to one or more of the Sites, you agree to these terms and conditions (“Agreement”).

Every effort has been made to ensure that the information provided is accurate. Individuals must not rely on this information to make a financial or investment decision, we recommend you consult a financial planner, accountant or stockbroker to take into account your particular investment objectives, financial situation and individual needs. Mafematica Pty Ltd does not provide general advice under and AFSL, nor personal advice, nor does it give any warranty as to the accuracy, reliability or completeness of information which is contained in this website or in the Reports it offers.

The information on this website has been prepared without a knowledge of client objectives, financial situations or needs. Information provided on this website is general in nature and does not constitute financial advice. Mafematica Pty Ltd will endeavour to update the website as needed. However, information can change without notice and Mafematica Pty Ltd does not guarantee the accuracy of information on the website, including information provided by its Reports, third parties, at any particular time.

Except insofar as any liability under statute cannot be excluded, Mafematica Pty Ltd and its employees do not accept any liability for any error or omission on this website or for any resulting loss or damage suffered by the recipient or any other person.

All the information on this website is published in good faith and for general information purposes only. We do not make any warranties about the completeness, reliability and accuracy of this information or that in any Report.

Your rights

As long as you comply with the Agreement, we give you the right to access, use and display one or more of the Sites. The contents of the Sites are for your personal, non-commercial use only except for those entities that have a reseller or other agreement with us. . You agree not to interrupt, or attempt to interrupt, the operation of the Sites in any way.

Protecting your password

When you subscribe with Mafematica, you’ll select a password. If our Customer Services team sets up your access, immediately change the generic password used for that purpose on your next log in. Take care to keep your password confidential and don’t disclose it to anyone.

Your privacy

We take protecting your privacy very seriously at Mafematica, and abide by the Australian Privacy Principles. You can read all about how we do this in our Privacy Policy here.

Confidentially and re-use of our Reports

Any information contained in a Report is for the subscriber and is general in nature. It must not be disclosed to other persons to be representative of any other person.

Any action you take upon the information on our website is strictly at your own risk, and we will not be liable for any losses and damages in connection with the use of our website. From our website, you can visit other websites by following hyperlinks to these sites.

Copyright and trade marks

Mafematica owns the copyright for material presented on the Sites, and some of our employees and/or contractors own moral rights.

If you use any Mafematica reports, articles, materials, photos, graphics, publications, products or equivalent materials including trade marks and other Mafematica intellectual property (“the Materials”), in whole or part, you must quote us as the source of the material, noting not to breach copyright or moral mis-use.

The Materials are protected in Australia and internationally by the law of copyright, moral rights, trade mark, equity, common law and other legislation such as the Competition and Consumer Act 2010.

We reserve the right to take legal action to prevent any unauthorised use or reproduction of the Materials, in whole or part, for any purpose including but not limited to advertising, copyright works, trade marks, logos and any commercial purpose use.

Links to other sites

We link out to other sites to give users additional info. We do not endorse, verify any of the information available from any link found within the Sites.

While we strive to provide only links to useful and ethical websites, we have no control over the content and nature of these sites and the links to other websites do not imply a recommendation for all the content found on these sites. Please be also aware that when you leave our website, other sites may have different privacy policies and terms which are beyond our control.

We welcome links from other sites to ours:

  • You may not copy or use any of the graphics (or other elements) from one of our Sites within another site – any link to us should be provided as a text link.

As a consumer, you have rights.

Under Australia’s Competition and Consumer Act 2010, you have remedies available to you if a service isn’t delivered with due care and skill. Your Mafematica subscription is no exception.

Prices

All our prices are in Australian dollars and include gst. We may change prices of services from time to time but we’ll let you know before this happens.

Payment of Referral Fees 

This disclosure is made in compliance with Regulatory Guide (RG) 168: Product Disclosure Statements (and other disclosure obligations) Issued by the Australian Securities & investments Commission on 28 October 2011.

Referral fees:
mProjections advises that third parties (or ‘Affiliates’) might make the Report available to visitors to their (the third party) web sites or to their social media followers, and that the third party may earn a referral fee in these circumstances. 

An Affiliate is a party that joins the Affiliate program promoted by mProjections on its web site.

A third party is any party that:
1. has registered as an Affiliate on the mProjections web site, including any party that has been referred by an existing mProjections Affiliate
2. includes the mProjections link on its web site and makes the mProjections Report available for its clients / members / visitors to purchase, or
3. a party who promotes this Report via social media.

The third party may be a financial services professional business or any other party that makes its web sites or social media available to the public whether or not the web-site or social media is open to selected members or the public at large.

A referral fee may be paid by mProjections to such third parties of no less than $2.99 including GST. If there are more than one referrer third parties, the total fee may be up to $5.98. These fee levels assume the recommended retail price of the Report is $19.95 including GST.

Referral fees are not payable by clients as an additional fee to the cost of the Report: the fees are payable by mProjections to the third party.

Additionally, a referral fee is payable by mProjections to the third party, or b/ where the client has visited the third party and later buys the mProjections Report directly with mProjections. The latter arrangement can occur via the use of cookies in the client’s computer and the ‘life’ of the referral fee arrangement via the cookie. This may continue for up to one year or any other period selected by mProjections and the third party.

The fee will be paid by mProjections to third parties from the fee paid by the buying client, and will be paid within 2 months of the client’s purchase.

How do my ongoing payments work?

When you become a member online, we’ll bill you on a recurring basis. We will advice you in advance of a subscription renewal, and you can cancel it, but if we have not been advised to cancel it, we will debit your nominated card or bank account. In other words, it’s up to you to cancel.

You can cancel your subscription payments at any time by:

  • logging in and going into ‘My Profile’ at Mafematica.com.au where you can cancel your subscription
  • emailing  us on ifo@mProjections.com.au

You’ll have access to all the services that come with your subscription until the end of your subscription term (to see the different subscriptions available to you, go to Mafematica.com.au/subscription).

So I can tell you I want to cancel my payments at any time?

Yep. Absolutely. The one thing you should know is that to avoid being charged for the next subscription period (remember, we said ‘recurring’), you need to notify us at least one (1) day before your subscription expires.

  • If you have an annual or longer term subscription, we’ll let you know that a new subscription term is about to start before we debit your nominated card or bank account.

If paying by credit card, it is important you know that if your card’s expiry date has changed and you haven’t updated the details in your profile or contacted us to let us know, your payments will continue to be deducted.

By agreement with the Payment Card Industry, recurring payments like subscription renewals can be processed on supplied credit cards past the expiry date, as long as the credit card number is still the same.

This is not a financial product

The mSmart mProjections Report is not a financial product and mSmart does not offer any financial products although Affiliates might offer financial products.
